Οι κατευθυντήριες γραμμές για μια φιλική προς τα παιδιά δικαιοσύνη και η αιτιολογική τους έκθεση εγκρίθηκαν από το Συμβούλιο της Ευρώπης το 2010. Οι εν λόγω κατευθυντήριες γραμμές, οι οποίες βασίζονται σε ισχύοντα διεθνή και ευρωπαϊκά πρότυπα, και συγκεκριμένα στη Σύμβαση των Ηνωμένων Εθνών για τα Δικαιώματα του Παιδιού και στην Ευρωπαϊκή Σύμβαση Δικαιωμάτων του Ανθρώπου, επιδιώκουν τη διασφάλιση της ουσιαστικής πρόσβασης των παιδιών στη δικαιοσύνη και της προσήκουσας αντιμετώπισής τους στους κόλπους του δικαστικού συστήματος, αφορούν δε όλες τις περιπτώσεις στις οποίες τα παιδιά είναι πιθανό, για οποιονδήποτε λόγο και με οποιαδήποτε ιδιότητα, να έρθουν σε επαφή με την ποινική, αστική ή διοικητική δικαιοσύνη. Υπενθυμίζουν και προ- άγουν τις αρχές του υπέρτατου συμφέροντος του παιδιού, της φροντίδας και του σεβασμού, της συμμετοχής, της ίσης μεταχείρισης και του κράτους δικαίου. Οι κατευθυντήριες γραμμές εξετάζουν διάφορα ζητήματα, όπως τα δικαιώματα στην πληροφόρηση, στην αντιπροσώπευση και στη συμμετοχή, την προστασία της ιδιωτικής ζωής, την ασφάλεια, τη διεπιστημονική προσέγγιση και κατάρτιση, τις εγγυήσεις σε όλα τα στάδια των διαδικασιών και τη στέρηση της ελευθερίας.

Τα 47 κράτη μέλη του Συμβουλίου της Ευρώπης καλούνται να προσαρμόσουν τα νομικά τους συστήματα στις ιδιαίτερες ανάγκες των παιδιών, γεφυρώνοντας το χάσμα μεταξύ των αναγνωρισμένων διεθνών αρχών και της πραγματικότητας. Για τον σκοπό αυτόν, η αιτιολογική έκθεση υποδεικνύει παραδείγματα ορθών πρακτικών και προτείνει λύσεις για την αντιμετώπιση και την κάλυψη νομικών και πρακτικών ελλείψεων στους κόλπους της δικαιοσύνης ανηλίκων.

Οι παρούσες κατευθυντήριες γραμμές συνιστούν αναπόσπαστο τμήμα της στρατηγικής του Συμβουλίου της Ευρώπης για τα δικαιώματα των παιδιών και του προγράμματός του με θέμα την «Οικοδόμηση μιας Ευρώπης για τα παιδιά, με τα παιδιά». Με γνώμονα την αποτελεσματική εφαρμογή των κατευθυντήριων γραμμών προς όφελος όλων των παιδιών, προγραμματίζονται διάφορες δρα- στηριότητες προώθησης, συνεργασίας και παρακολούθησης στα κράτη μέλη.
