Çocuk dostu adalete ilişkin rehber ilkeler ve açıklayıcı bildiri Avrupa Konseyi tarafından 2010 yılında kabul edilmiştir. Mevcut uluslararası standartları ve Avrupa standartlarını, özellikle Birleşmiş Millerler Çocuk Hakları Sözleşmesini ve Avrupa İnsan Hakları Sözleşmesini esas alan bu rehberlik ilkeleri, çocukların adalet sistemine etkili erişimini ve bu sistem içinde gereken muameleyi görmesini güvence altına alacak şekilde tasarlanmıştır. Bu rehber ilkeler çocukların, hangi nedenle ve hangi kapasitede olursa olsun, ceza, hukuk ya da idari adalet sistemiyle ilişkisi olabileceği bütün durumlar ve koşullar için geçerlidir. Bu ilkeler çocuğun yüksek menfaatleri, özen ve saygı, katılım, eşit muamele ve hukukun üstünlüğü prensiplerini hatırlatarak teşvik etmekte ve bilgilendirilme, temsil edilme ve katılım hakları, mahremiyetin korunması, güvenlik, çok disiplinli yaklaşım ve eğitim, davanın bütün aşamalarında koruyucu tedbirler ve özgürlükten mahrum bırakılma gibi konuları ele almaktadır.
Rehber Avrupa Konseyinin 47 üye ülkesini, kendi hukuk sistemlerini çocukların belirli ihtiyaçlarına göre uyarlamaya, uluslararası kabul edilmiş prensiplerle aradaki farkı kapatmaya teşvik etmektedir. Bu amaçla, açıklayıcı bildiri iyi uygulama örnekleri vermekte ve çocuklar için adalet sistemindeki hukuk ve uygulama boşluklarının ele alınmasına ve çareler bulunmasına yönelik çözüm yolları önermektedir.
Bu rehber, Avrupa Konseyinin çocuk haklarına ilişkin stratejisinin bir parçasıdır. Rehber’in tüm çocukların yararına etkili bir biçimde uygulanması maksadıyla bir dizi teşvik, işbirliği ve izleme faaliyeti üye ülkelerde planlanmaktadır.
