Im Bereich der Medien - einschließlich der audiovisuellen Medien - bestehen zahlreiche Möglichkeiten für eine Kollision des Interesses der Medien an der Nutzung persönlicher Daten mit den Interessen der Betroffenen am Schutz derselben. Man denke an Reportagen über Personen des öffentlichen Lebens, an Nachrichten über Strafrechtsverfahren oder Berichte aus dem Bereich des Enthüllungsjournalismus. Im Zeitalter der bidirektionalen Kommunikation gibt es darüber hinaus Konstellationen, in denen auch die Nutzer von Mediendiensten um den Schutz ihrer persönlichen Daten besorgt sind.

Der Schutz personenbezogener Daten und die Medien
Der Leitbeitrag dieser IRIS plus leistet Hilfestellung bei der Ordnung der zahlreichen möglichen Konstellationen von Datennutzung rund um die miteinander in Konflikt stehenden Menschenrechte. Er unterscheidet zwei grundsätzliche Situationen: Erstens Fälle, in denen audiovisuelle Medien die Daten von Betroffenen zugänglich machen, und zweitens Fälle, in denen es um den Schutz von Daten der Nutzer solcher Medien geht. Der Leitbeitrag erläutert die bestehenden EU-rechtlichen Regelungen und erklärt, auf welche Weise bislang der Interessenausgleich zwischen Medien und Betroffen bzw. Medien und Mediennutzern in verschiedenen typischen Fragestellungen vorgenommen wurde.
