Les vives protestations qu'a suscitées la signature de l'Anti-Counterfeiting Trade Agreement (Accord commercial anti-contrefaçon - ACTA) dans de nombreux pays européens en février 2012 mettent en lumière le numéro d'équilibriste auquel doit se livrer le législateur pour instaurer une protection des droits de propriété intellectuelle. Les intérêts des utilisateurs et des ayants droit doivent être mis en balance de façon jugée « équitable ».Alors que la controverse sur l'aménagement des droits d'auteur s'intensifie, il règne néanmoins un certain consensus pour reconnaître que le piratage, c'est-à-dire la violation délibérée de ces droits, doit être combattu de manière systématique. Le présent numéro d'IRIS plus est consacré à la lutte contre le piratage sur Internet, thème qui revêt une acuité particulière du fait de l'efficacité croissante des échanges de données électroniques et de l'augmentation simultanée des infractions au droit d'auteur.

La lutte contre le piratage sur internet en Russie : le cadre juridique et son élaboration

Rares sont les pays où les défis en matière de protection des droits de propriété intellectuelle en général, et des produits audiovisuels en particulier, ont pris autant d'ampleur qu'en Russie.

En 2011, la Russie se classait encore en tête de tous les pays pour le piratage, d'après une étude comparative sur les ressources en ligne. Mais depuis peu, on observe un nombre croissant de signes indiquant que la Russie a entamé un tournant radical dans ce domaine. L'adhésion imminente de la Russie à l'OMC et une volonté politique crédible de renforcer la protection juridique de la propriété intellectuelle en font partie. Dans les médias russes, les comptes rendus des affaires de droit d'auteur ont même fait les gros titres récemment, et un débat public s'est ouvert sur la protection des droits de propriété intellectuelle.
