Dans une Europe où les frontières nationales tendent à s’estomper, la problématique de la police doit être traitée dans une perspective internationale. Outre la lutte contre la criminalité, le débat porte sur les limites des pouvoirs de la police dans une société démocratique, au regard de la protection des libertés et des droits fondamentaux de
l’individu. Il faut parvenir à un juste équilibre entre les intérêts en jeu et trouver les moyens de le maintenir.
Le Code européen d’éthique de la police énonce les normes fondamentales devant s’appliquer aux services de police dans des sociétés démocratiques régies par les principes de l’Etat de droit. Au-delà d’un code d’éthique « traditionnel », ce texte trace un cadre général pour l’organisation de la police, sa place dans le système de justice pénale, ses objectifs, son fonctionnement et ses responsabilités. Certaines parties du texte sont conçues pour servir de modèle aux lois et aux codes de conduite et d’éthique nationaux.
Le code et l’exposé des motifs donnent des orientations aux gouvernements des Etats membres du Conseil de l’Europe et devraient être une source d’information et d’inspiration pour les praticiens de la police comme pour le grand public.
