Die neueste Ausgabe von IRIS plus befasst sich mit der aktuellen europäischen Gesetzgebung zur Öffnung der Archive des öffentlichen Sektors. Seit ihrer Überarbeitung im Jahr 2011 gilt die Richtlinie über die Weiterverwendung von Informationen des öffentlichen Sektors auch für Filminstitute, Museen und Bibliotheken.

Aber was bedeutet das für die Weiterverwendung ihrer Archivbestände? Welche Probleme gibt es mit dem Urheberrechtsschutz? Wie sehen die wirtschaftlichen Folgen für die Archive selbst aus? Und wie geht das Recht derzeit mit verwaisten Werken um?

Eine ganz neue Studie über die europäische Richtlinie, die uns den Schlüssel für die Öffnung von Europas Schatzkammern in öffentlichen Archiven an die Hand gibt.

Informationen des öffentlichen Sektors und audiovisuelle Archive

 

Der Leitbeitrag dieser neuen Ausgabe analysiert die PSI-Richtlinie (Richtlinie über die Weiterverwendung von Informationen des öffentlichen Sektors), die erstmals 2003 verabschiedet wurde. Diese Richtlinie ist das wichtigste Rechtsinstrument, das in Europa die Weiterverwendung von Informationen des öffentlichen Sektors regelt, die in unseren Archiven gespeichert sind. Wir untersuchen die Hintergründe, die zur Entstehung dieser Rechtsvorschrift geführt haben, bevor wir uns mit den Änderungen in den Jahren 2008 und 2011 befassen. Dieser Artikel untersucht auch die Absicht, die hinter dieser Richtlinie steckt, und analysiert anschließend die Folgen, welche die Änderungen des Jahres 2011 für Museen, Filminstitute und Bibliotheken haben, die nun ebenfalls unter ihren Anwendungsbereich fallen.
