Le dernier numéro d'IRIS plus examine la législation européenne actuelle visant à ouvrir nos archives publiques. Les archives cinématographiques, les musées et les bibliothèques relèvent désormais du champ d'application de la directive concernant la réutilisation des informations du secteur public depuis sa révision en 2011.

Mais qu'est-ce que cela signifie en termes de réutilisation des trésors de leurs archives ? Quels problèmes cela pose-t-il au niveau du droit d'auteur ? Quelles sont les conséquences économiques pour les archives elles-mêmes ? Quel est le régime juridique actuellement applicable aux oeuvres orphelines ?

Données publiques et archives audiovisuelles

 

L'article de fond de ce nouveau numéro procède à l'analyse de la directive ISP (informations du secteur public), adoptée initialement en 2003, qui constitue le cadre juridique majeur en Europe pour règlementer la réutilisation des archives du service public. Nous retraçons l'historique de cet instrument juridique depuis sa création jusqu'à sa révision en 2008, puis en 2011. L'article analyse l'intention première ayant motivé la création de cette directive, avant d'examiner les conséquences de sa révision en 2011 pour les musées, les instituts cinématographiques et les bibliothèques, qui sont alors entrés dans son champ d'application.
