Der Schutz vor Diskriminierung in Europa findet sich sowohl im EU-Recht als auch im Recht des Europarats. Beide Systeme funktionieren getrennt voneinander, können sich aber durch ihre Rechtsprechung gegenseitig beeinflussen.

Das europäische Antidiskriminierungsrecht verbietet insbesondere nach Maßgabe der Antidiskriminierungsrichtlinien der EU, des Artikels 14 der Europäischen Menschenrechtskonvention sowie des Protokolls Nr. 12 zu dieser Konvention die Diskriminierung in einer ganzen Reihe von Bereichen und aus einer Vielzahl von Gründen. Dieses Handbuch untersucht den europäischen Rechtsrahmen zur Nichtdiskriminierung, der sich auf diese beiden Quellen als einander ergänzende Systeme gründet, auf die unterschiedslos Bezug genommen wird, soweit sie sich überschneiden; zugleich wird gegebenenfalls auf bestehende Unterschiede aufmerksam gemacht. Es enthält auch Verweise auf andere Instrumente des Europarates, insbesondere die Europäische Sozialcharta, sowie auf einschlägige Rechtstexte der Vereinten Nationen. Angesichts des beeindruckenden Umfangs der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte und des Gerichtshofs der Europäischen Union im Bereich der Nichtdiskriminierung erscheint es sinnvoll, ein zugängliches Handbuch für juristische Fachleute wie Richter, Staatsanwälte, Rechtsanwälte und Strafverfolgungsbeamte in den Mitgliedstaaten der EU und des Europarates sowie in anderen Ländern zur Verfügung zu stellen.
