Die Leitlinien für eine kindgerechte Justiz und ihre Begründung wurden im Jahr 2010 vom Europarat angenommen. Basierend auf den bestehenden internationalen und europäischen Standards, insbesondere dem Übereinkommen der Vereinten Nationen über die Rechte des Kindes und der Europäischen Menschenrechtskonvention, wurden die Leitlinien entworfen, um den wirksamen Zugang der Kinder zur Justiz und eine angemessene Behandlung durch die Justiz zu gewährleisten. Sie finden auf alle Fälle Anwendung, in denen Kinder aus welchem Grund und in welcher Eigenschaft auch immer mit dem Straf-, Zivil- oder Verwaltungsrechtssystem in Kontakt kommen könnten. Die Leitlinien nehmen Bezug auf die Grundsätze des Kindeswohls - Fürsorge und Respekt, Beteiligung am Verfahren, Gleichbehandlung und Rechtsstaatlichkeit - und fördern sie. Sie befassen sich mit Themen wie Recht auf Information, Vertretung und Teilnahme am Verfahren, Schutz der Privatsphäre, Sicherheit, multidisziplinärer Ansatz und Schulung, Rechtsschutz in jedem Verfahrensabschnitt und Freiheitsentzug.

Die 47 Mitgliedstaaten des Europarates werden dazu aufgefordert, ihre Rechtssysteme an die besonderen Bedürfnisse der Kinder anzupassen und die Kluft zwischen international anerkannten Grundsätzen und der Realität zu überbrücken. Zu diesem Zweck enthält die Begründung eine Reihe von Beispielen für bewährte Praktiken und schlägt Lösungen vor, wie rechtliche und praktische Lücken in der Justiz für Kinder angegangen und geschlossen werden können.

Die vorliegenden Leitlinien stellen einen wesentlichen Bestandteil der Strategie des Europarates für die Rechte des Kindes und seines Programms „Aufbau eines Europas für Kinder und mit Kindern“ dar. In den Mitgliedstaaten ist eine Reihe von Förder-, Kooperations- und Überwachungsmechanismen für die Gewährleistung einer wirkungsvollen Umsetzung der Leitlinien zum Nutzen aller Kinder geplant.
