Vaiko interesus atitinkančio teisingumo gaires ir jų aiškinamąjį memorandumą Europos Taryba priėmė 2010 m. Remiantis galiojančiais tarptautiniais ir Europos standartais, visų pirma Jungtinių Tautų vaiko teisių konvencija ir Europos žmogaus teisių konvencija, šiomis gairėmis siekiama užtikrinti vaikams veiksmingą teisę kreiptis į teismą ir teisę į tinkamą elgiasi su jais teisingumo sistemoje. Šios gairės taikomos visoms aplinkybėms, kuriomis vaikai bet kokiu pagrindu ir bet kokiu vaidmeniu gali susidurti su baudžiamojo, civilinio ar administracinio teisingumo sistema. Šiose gairėse primenami ir remiami vaiko interesų, rūpinimosi ir pagarbos, dalyvavimo, vienodo požiūrio ir teisinės valstybės principai. Gairėse nagrinėjami tokie klausimai kaip informavimas, atstovavimas ir dalyvavimo teisės, privatumo apsauga, saugumas, tarpdalykinis požiūris ir mokymas, apsaugos priemonės visų procesų etapų metu ir laisvės atėmimas.
Keturiasdešimt septynios Europos Tarybos valstybės narės raginamos pritaikyti savo teisines sistemas prie specialių vaikų poreikių ir taip sumažinti atotrūkį tarp tarptautiniu mastu suderintų principų ir tikrovės. Tuo tikslu aiškinamajame memorandume pateikiama gerosios patirties pavyzdžių ir siūloma, kaip būtų galima šalinti teisines ir praktines spragas
teisingumo sistemoje, pritaikytoje vaikams.
Šios gairės yra neatsiejama Europos Tarybos vaiko teisių strategijos ir jos programos „Kurkime Europą vaikams ir su vaikais“ dalis. Siekiant visų vaikų labui užtikrinti veiksmingą šių gairių įgyvendinimą, valstybėse narėse planuojama imtis įvairios skatinimo, bendradarbiavimo ir stebėsenos veiklos.
